GENERAL TERMS AND CONDITIONS MEMBERSHIP JFD CLUB

ARTICLE 1 – GENERAL PROVISIONS

 

These general subscription terms and conditions (hereinafter the “General Terms and Conditions”) apply by right to any JFD Club subscription (hereinafter the “Subscription”). 

Signing the subscription form taken out online, upon receipt of the electronic confirmation of the Subscription including the Subscription form previously accepted by the subscriber, implies full acceptance of the General Terms and Conditions. Where the various Subscription formulas are subject to special conditions, these are explained in the clauses below.



ARTICLE 2 – MEMBERSHIP JFD CLUB

 

2.1. Subscription to the JFD Club commits the subscriber, a member of the JFD Club, the Subscription payer, responsible for payment of the Subscription (if the payer is different from the subscriber), THE BUREAU, the JFD Club Subscription provider, whose head office is located at 18 rue Littré, 75006 Paris. 

The Subscription is taken out online on the website www.joinjfd.com under the heading “JFD Club” (hereinafter the “Site”).

 

2.2. The Subscription is strictly personal; it is materialised by the reception of an email with the surname, first name and associated membership number when the subscriber has registered on the Site. 

Subscription to the JFD Club is effective upon receipt of payment by the Bureau. 

 

2.3 Initial term of the Subscription (hereinafter the “initial period”): the Subscription has an initial term of twelve (12) months.

 

 

2.4 In the absence of termination two full calendar months plus the month in which the Bureau received the request for termination, and this before the end of the term, the Subscription paid by credit card shall automatically continue beyond the initial period, for an indefinite period. Thereafter, it may be terminated at any time by giving two full calendar months’ notice plus the month in which the Bureau received the request for termination. The Subscription paid in cash will automatically end at the end of the initial period.

 

2.5 Withdrawal: In accordance with Article L.221-18 et seq. of the French Consumer Code, the subscriber who has subscribed to the Subscription on the Site has a period of fourteen (14) clear days at the latest from receipt of an email with the surname, first name and associate member number, to exercise his or her right of withdrawal without having to give any reason or pay any penalties. By exception, the subscriber expressly waives his or her right of withdrawal by taking advantage of the JFD Club member offers before the end of the fourteen (14) day period mentioned above. To exercise his right of withdrawal, the subscriber must send an email to jfd@thebureau.fr confirming his intention to withdraw with the following information: name, email and member number. The reimbursement will correspond to the totality of the sums paid by the same means of payment as that used to pay the price of the Subscription and at the latest within fourteen (14) days following the date of withdrawal. 



 ARTICLE 3 – PAYMENT OF THE SUBSCRIPTION

 

3.1. The price of the Subscription is the price shown on the Subscription form in force on the day the Subscription is taken out on the Site.

 

3.2. The price of the Subscription is payable according to the methods described below. 

Cash payment online by credit card on the day of the Subscription subscription. 

The amount must correspond to the 12 monthly instalments at the current rate. At the end of the initial period and if the Bureau does not receive payment for the Subscription for a new period, the Subscription will be terminated automatically.

 

3.3. When subscribing to the Subscription on the Site, bank details must be provided at the “Payment” stage. 

 

3.4. The Subscriber who wishes to change his or her direct debit bank or account must contact jfd@thebureau.fr in order to communicate his or her new details, so that there can be no interruption in the direct debits: any interruption in the direct debits may lead to the suspension or termination of the Subscription under the conditions stipulated in Article 5 below. 

 

3.5. Payment of the Subscription price may be made by a person other than the subscriber, but the payer must be over eighteen years of age; the same payer may be responsible for the payment of several Subscriptions; the payer guarantees the subscriber’s compliance with these General Conditions.

 

3.6 It is understood that any increase in the price of the Subscription will be notified at least two months in advance, so that the subscriber can request, if necessary, the cancellation of his Subscription before the said price increase. Any rate increase may only be applied to subscribers at the end of the initial period of their current Subscription. If the Subscription is continued after the initial period, the price of the Subscription may thus be increased to correspond to the new price in force and the amount of the direct debits will be adjusted proportionally to the changes in the price of the Subscription.

 

3.7. The payment system offered on the Site is the one managed by the company Stripe, Ltd. The Site never has access to confidential information relating to the payment method. Indeed, only Stripe, Ltd has access to confidential information (card number, validity date) which is inaccessible to third parties. 



ARTICLE 4 – TERMINATION AND SUSPENSION OF THE SUBSCRIPTION BY THE MEMBER

 

4.1. During the initial period, the Subscriber may not terminate the Subscription.

 

4.2. After the initial period, the subscriber may terminate the Subscription :

  • for a legitimate reason (e.g. moving abroad, long-term hospitalisation, death), by any means for which the burden of proof of receipt by the Bureau shall rest with the subscriber, mentioning the said reason and accompanied by all the necessary supporting documents; if this termination is accepted, it shall only take effect at the end of the month in progress at the time of receipt of the termination request by the Bureau.
  • by any means for which the burden of proof of proper receipt by the Bureau shall be incumbent on the subscriber, subject to a notice period of two full calendar months, with the termination only taking effect at the end of the second calendar month following the month in which the Bureau received the termination request. 



ARTICLE 5 – TERMINATION OF THE SUBSCRIPTION BY THE BUREAU

 

5.1. The Subscription is terminated by the Bureau on the following grounds

  • in the event of fraud in the constitution of the Subscription file, false declaration, falsification of attachments ;
  • in the event of fraud in the use of membership; and in particular in the following cases: in the event of resale of a ticket to an event, in the event of use of membership for profit or for purposes other than a JFD Club activity;
  • in the event of failure to pay in full or any amount due under the Membership.

 

In all of the above cases of termination, the Subscriber shall owe, as a penalty, the amount of the Subscription up to its expiry date when the termination occurs during the initial period or two monthly instalments plus the current month if the end of the initial period is less than two full calendar months; and in any event two monthly instalments plus the current month when the termination occurs at the end of that period. The Bureau reserves the right to recover the amount of the debt in court. 

 

5.2. The Bureau reserves the right to suspend for a period of three years any new application for a Subscription from a subscriber and/or payer (as the case may be) whose Subscription has been terminated under the conditions set out in Article 5.1. In the event of non-payment, the suspension will be lifted when the subscriber’s situation is regularised.

 

5.3. The Bureau reserves the right to interrupt the unlimited subscription formula at any time under the following conditions

if the decision to interrupt the subscription formula occurs during the initial period, the Bureau will notify the decision to stop the Subscription but the subscriber will retain the benefit of the membership until the expiry of the said initial period;

if the decision to discontinue the subscription formula occurs after the initial period, the Bureau may terminate the Subscription at any time subject to two full calendar months’ notice, with the Subscription terminating at the end of the second calendar month following the month in which the Bureau notifies the subscriber that the Subscription has been discontinued.



ARTICLE 6 – RESPONSIBILITY OF THE BUREAU

 

The Bureau, whose contact details are given in article 2.1, is available to subscribers for any questions concerning the Subscription. Any complaint or change in the situation of subscribers must be sent to the Bureau at 18 rue Littré, 75006 Paris or to jfd@thebureau.fr, at the latest one month after the date of the event.

 

 

ARTICLE 7 – LAW AND LITIGATION

 

The General Conditions are subject to French law. In the event of a dispute, the subscriber shall first contact the Bureau, 18 rue Littré, 75006 Paris or jfd@thebureau.fr, to obtain an amicable solution.

 

 

ARTICLE 8 – DATA PROCESSING AND FREEDOM

 

Personal data concerning the subscriber is collected by the Bureau, SAS with a capital of €1,000, whose registered office is located at 18 rue Littré, 75006 Paris, in accordance with the privacy policy. 

The information collected is intended for subscription purposes, subscriber identification, sending information on JFD Club offers and events, and more generally for customer relationship management and statistical purposes relating to marketing and the use made of subscriptions. 

The information will be used by our internal departments and may also be communicated to third parties contracted by the Bureau to perform subcontracted tasks, including account management, reservations and payments.

The data marked with an asterisk, which is necessary for the above-mentioned processing, is obligatory; if it is not provided, the Bureau will not be able to process the client’s request. The other information requested is optional.

Upon express acceptance by the subscriber when communicating his or her data, such data may be communicated to JFD Club commercial partners. At any time upon receipt, the subscriber may indicate his or her wish to no longer receive such mailings by clicking on the message that will accompany the mailing.

The subscriber’s personal data are kept for the duration of the Subscription. At the end of the Subscription, the data is kept for three years by the Bureau.

 

 

ARTICLE 9 – EVOLUTION OR MODIFICATION OF THE GENERAL TERMS AND CONDITIONS

 

These General Terms and Conditions may be amended in order to comply with current legislation and/or the terms and conditions of the Subscription and/or if the way in which we process your data in the context of our activities changes. We will ensure that the most recent version of the Terms and Conditions is published on the Site. Where material changes are made to these Terms and Conditions, we will notify you by posting a notice online or by sending you an email within a reasonable period of time before it comes into effect, in accordance with applicable regulations.
